Halcon Marong Pty Ltd (ABN 94 701 406 706) is a property investment and development company based in Perth, Western Australia. We assist clients with property acquisition, development planning, project coordination and related advisory services, as further described on our Services page.

3. General information only — not financial advice

4. Quotes and engagement

• Any quote we provide is an invitation to engage our services and is valid for 30 days from the date of issue unless otherwise stated in writing.
• A binding engagement arises only when both parties sign a written service agreement or letter of engagement.
• Quotes are based on the scope, assumptions and information available at the time they are prepared and may change if the scope or those assumptions change.

5. Fees and payment

• Fees for our services will be set out in the applicable written service agreement.
• Unless otherwise agreed in writing, invoices are payable within 14 days of the date of issue.
• Overdue amounts may, to the extent permitted by law, attract interest and reasonable costs of recovery.
• Third-party costs incurred on your behalf (such as council fees, consultant fees or statutory charges) will be on-charged at cost unless otherwise agreed in writing.

6. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot be excluded, restricted or modified by agreement.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For services of a kind ordinarily acquired for personal, domestic or household use or consumption, you are entitled to a refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services rectified or, where rectification is not possible, re-supplied if the failure does not amount to a major failure.

7. Limitation of liability

To the maximum extent permitted by law, and subject to clause 6 (Australian Consumer Law):

• we exclude all representations, warranties and conditions in relation to the website and our services that are not expressly set out in these terms or in a signed service agreement;
• we are not liable for indirect, incidental, special or consequential loss or damage, including loss of profit, loss of opportunity or loss of anticipated development gains; and
• where liability cannot be excluded, our total aggregate liability for any claim is limited, at our option, to the resupply of the relevant services or the cost of resupplying them.

Nothing in this clause limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited.
